Good News for Federal Prison Inmates

On July 18, 2014, the U.S. Sentencing commission determined that almost 50,000 incarcerated, federal drug offenders are eligible for a potential reduced federal prison sentence, which will allow a federal judge to review these federal prison inmates’ cases once more. Now, both prospective federal sentences of future federal drug offenders and about half of those federal drug offenders already in federal prison, are able to make cases for a more lenient federal prison sentence.

In the upcoming year, federal judges will assess federal prisoners’ requests for leniency. The standards for federal prison sentencing depends on a point system based on certain elements of a federal prisoner’s crime, such as if the federal offender has been sentenced previously, or if the federal offender used a weapon to commit the federal crime. This decision reduces the point value associated with federal drug trafficking, and some estimate that this federal prison sentence reduction will result in an average federal prison sentence decrease of 25 months in federal prison.
